License Agreement

PLEASE READ THE FOLLOWING LICENSE AGREEMENT CAREFULLY BEFORE PURCHASING OR DOWNLOADING THE DIGITAL CONTENT.

“Digital Content” shall mean any assets included in the downloadable file. This includes but is not limited to the design, artworks, Live2D models, 3D models, and scripts.
“Licensor” shall mean 0x4682B4 (“Hexose” or “六碳糖”).
“Licensee” shall mean a natural person who purchased and obtained the Digital Content from the licensor’s official release. Legal persons (companies, corporations, or groups) are not eligible to become Licensees by purchasing the Digital Content.
This agreement is made between the Licensor and the Licensee (“you”). By purchasing the Digital Content, you accept all the terms listed in this agreement.1. LICENSE GRANT. The Licensor grants you a non-exclusive, non-transferable license to use the Digital Content for non-commercial and commercial purposes, provided that you follow the terms in this Agreement.2. TERM OF USE.
You shall NOT:
• Claim or imply that you are the author of the Digital Content.
• Claim or imply that you are the copyright holder or the intellectual property owner of the Digital Content.
• Resell or redistribute the Digital Content or copies of the Digital Content.
• Transfer, sublicense, or rent rights to use the Digital Content to third parties directly or indirectly.
• Make destructive, insulative, or offensive changes to the Digital Content.
• Create any works that involve controversial topics or sensitive information including but not limited to political, religious, or celebrity-related topics.
• Engage in inappropriate activities including but not limited to abusive, offensive, and hateful behaviours.
• Use the Digital Content in activities related to non-fungible tokens (NFTs), cryptocurrencies, or artificial intelligence (AI) generated art.
You may:
• Use the Digital Content in commercial activities including but not limited to VTuber activities, live streaming, and video creation.
• Make modifications to the Digital Content within the allowed range.
• Create derivative works based on the Digital Content.
• Sell merchandise of the derivative works created based on the Digital Content.
• Integrate the Digital Content into software or apps, provided that proper measures were taken to prevent third parties from gaining access, extracting, or using the original Digital Content and that the usage rights were not transferred, sublicensed, or rented to third parties.3. INTELLECTUAL PROPERTY. The Licensor owns the copyright and other intellectual property rights to the Digital Content and copies. These rights are protected by laws, regulations, and international treaties. No rights were transferred or assigned to the Licensee through their purchase of the Digital Content.4. AMENDMENTS. The provision of this Agreement is subject to change. The Licensor may amend the terms under this Agreement, including but not limited to additions, changes, or deletions, by releasing updates on the original release page of the Digital Content or their website. Therefore, you shall check the information released by the Licensor on a regular basis.5. TERMINATIONS. Your license will terminate if you violate any term in this agreement. You must remove all copies of the Digital Content from your devices and stop using the Digital Content. Any published works containing the Digital Content that violate the term of this Agreement must be removed. Certain measures will be taken by the Licensor to remove works that violate the terms or infringe the Licensor’s rights with or without prior notice.6. LIMITED WARRANTY. The Digital Content is provided “as-is.” The Licensor gives no express nor implied warranties, guarantees or conditions.7. LIMITED LIABILITY. Q: Can you give me permission to use the model?
A: No, I don't give permission to individuals. As long as you read and follow the LICENSE AGREENMENT and your usage is within the defined scope, the permission is automatically granted, so no need to double-check with me.Q: Can I use the model picture and the emotes included in the .zip file as my pfp/channel art/chat emotes/etc.?
A: Yes, as long as you are a valid user of the model. However, if you were managing an art account or taking art commissions, please credit me (e.g. pfp by 0x4682B4) to avoid someone mistaking you as the creator of those artworks.Q: Can I edit the model texture/add items to the model? What kind of edits are allowed?
A: Yes, as long as the change is not destructive, insulative, or offensive. For example, removing part of the hair or an arm of the model, covering part of the texture in a solid colour, or using AI tools to reprint my art are not allowed.Q: Can I call you Mama/Papa?
A: Yes, as long as it will not cause misunderstanding.
You can use "Art & Rig", "Mama/Papa", "Live2D Model" or any other widely accepted formats.Q: Can you do personalized editing for me?
A: No, I do not offer editing services for free or P2U models unless the model is listed as a template HERE.Q:Can you provide the .cmo3 file/original file/editable file?
A: No.Q: Can I share the textures or the expression files?
A: Yes, but only between authorized licensors.

Artworks

Basic rules:
1. Reposting is NOT allowed. I will NOT give anyone permission to repost my art.
2. Commercial/promotional uses are NOT allowed
Commercial uses examples: selling the art itself or any derivatives/merchandise of the artwork.
Promotional uses examples: using it in your portfolio (for job search/accepting commissions).
3. Modifications are NOT allowed.Q: Can I use it as my profile picture for my social media accounts?
A: Yes, credit is required for public accounts (like a Twitter account). No limitations on personal accounts (like a Google account or WeChat account).Q: Can I print it out/give the copies to my friends?
A: Yes. In general, fewer than 4 copies are allowed if you want to print it out.Q: Any thoughts about AIs?
A: Personally, I do not against AI-generated art or the technology itself in any way. But I do hate some AI "artists" and their way of using AIs. Artists often find it offensive if people paint over/trace their art, mimic their style in an uncomfortable way, or modify their art without permission. Same thing if people let AI do the job instead of using painting software themselves.
If someone uses AI to paint over my art, mimics my style, or uses AI to "finish"/"improve" my work, I will find it offensive. Of course not by the AI, but by the person who did it.

Q: Do you have a waitlist?
A: Currently, I don't do not have any waitlist.Q: Do you accept other types of commission that are not listed in the commission section?
A: Yes. In that case, please fill out the application form and provide details and budget for the commissioned work.

Live2D

Q. Can I get a "lower tier" rig for a cheaper price?
A: Sorry, currently I don't offer that option.Q. What face-tracking software and equipment do you use?
A: VTubeStudio. I use VBridger+iFacialMocap ARKit face tracking on an iOS device. I can also test the model with the NVIDIA Broadcast Tracker+Logitech C920 webcam. But for the best result, I still recommend using VBridger + ARKit face-tracking.Q. Will you provide a more detailed price list?
A: I will not have a detailed price list since I found it hard to make one. Even toggle expressions can have many variations. For example, I can have the sticker just appear; I can add some physics to it to give it a bouncy feeling; or I can even make an animation for it. The complexity also depends on how the sticker was drawn and whether the sticker has multiple parts. Classifying those into "complex toggle " and "simple toggle" is not accurate enough. Also, I have to be able to define each category. Besides, It is hard to quantitatively decide how much time I have to spend on each part.

Commission Agreement

Q: Do I have to use my full legal name for the Commission Agreement?
A: No, you don't have to. However, your email address must match your PayPal account email.Q: How formal/serious this Agreement is?
A: Not very seriously. Since it is practically impossible for me or the client to take any cross-country/province/territory legal action there is really no point in composing a very formal and detailed contract that cannot be enforced. I just want to have everything written down and be transparent to avoid any possible dispute even if the possibility is quite low.Q: What counted as one revision?
A: Revision request->I made revisions to the file accordingly->I give you the feedback.
If multiple parts need to be revised, the description must be sent in one single email or one single paragraph text (if other chat tools were used).Q: A significant part of the Agreement is about agreement termination. Does this mean that it is likely to happen?
A: No. I include many details just to prevent any possible dispute. Under normal circumstances, I will not cancel a commissioned work if the client already paid the deposit. But there is still a small possibility for unexpected personal or family emergencies. In that case, the Client can choose to postpone the delivery date or to commission other artists.

Q: Which form should I use?
A: Use the Live2D application form for Live2D art, Live2D rig and Live2D art + rig commissions. Use the general application form for template-based commissions and all other types of commissions.Q: Can I use the old/obsolete form?
A: Yes.
